The website of Skywest Holidays ("the Site") is owned and operated by the Creative Tours Pty ABN 23 00 328 6459 ("we", "us", "our", “The Company”). This document sets out the terms and conditions ("Terms & Conditions") under which you may make a booking for the provision of products or services offered on the Site. Please read the Terms & Conditions carefully. If you do not accept the Terms & Conditions stated in this document you should not make any booking for any of the products and/or services offered on the Site. By making a booking for any one or more of the products and/or services offered on the Site, you are indicating your acceptance to be bound by these Terms & Conditions and by the terms and conditions of the actual provider of the service or product in respect of which you have made a booking.

1. Website Information

1.1 The Site displays information about travel locations, airfares, flight times and packages, transportation, schedules, entertainment schedules and events and many other things.

1.2 Most of this information is supplied to us by third party providers including (but not limited to) airlines, hotels, car hire companies, tour operators, event organisers and the like. Therefore, although we have taken reasonable care to ensure that this information is correct and up-to-date, we cannot check the accuracy of such information where provided to us by third parties.

1.3 All bookings with us and pursuant to the Site are subject to the terms and conditions and limitations of liability imposed by the provider of the services and/or products, as the case may be.

1.4 We accept no responsibility for information supplied to us by third parties or for the provision of the services and/or products.

2. Prices, Travel Restrictions and Conditions

2.1 Restrictions and conditions apply to all of the products and services offered on the Site. To determine the applicable restrictions and conditions, you may need to contact the relevant third party provider or us.

2.2 The third party providers of the products and services offered on the Site may change their prices and/or packages, services, products and other information displayed on the Site at any time. Therefore, all information displayed on the Site is subject to change without notice.

2.3 All products and services described on the Site are subject to availability.

2.4 The prices set out on the Site may not include taxes (including but not limited to GST), airport charges or like duties, taxes or imposts. Such charges will be advised to you once you have made a booking with us and we have confirmed the booking with the relevant third party provider. Such charges are subject to change without notice.

2.5 You are responsible for obtaining all passport, visa and health information that you may require. You are responsible for satisfying all conditions (if any) required in respect of any of the products and services you book on the Site. 2.6 You should also arrange to have insurance. We recommend travel insurance against loss of funds through cancellation charges, baggage loss, medical expenses and theft. We make no representation or guarantee concerning reimbursement of funds paid by you under any insurance claim. You agree not to hold the company responsible for any decision made by insurers, and/or by any service providers, or requirements of any overseas country or government authority or overseas laws policy. 2.7 Unless otherwise expressly stated, prices do not include visa and passport costs, travel insurance, vaccination and medical expenses, excess baggage, airport departure taxes, laundry, postage, phone calls, fax/email charges, beverages, items of a personal nature, tips and meals not mentioned on the itinerary. You are responsible for these charges in addition to any other charges in relation to your arrangements/booking.

2.8 The prices set out on the Site are not offers but quotes subject to change. Whilst we endeavour to provide you with timely and accurate information on the Site, the prices on the Site are subject to change without notice, up to the time a booking is made and accepted and payment for the booking received and available to us.

2.9 Prices set out on the Site may be quoted in a currency other than Australian currency. Currencies may be subject to change without notice and we make no representation or warranty that a price for a product or service will not change due to currency fluctuations. Unless otherwise indicated, all currencies shown on the Site are in Australian currency.

2.10 Room Bedding Information: Prices advertised are based on existing bedding in the room. Requests for particular bedding arrangements must be made at the time of booking and can not be guaranteed.

2.11 Unused Service: Unused service will not be refunded or exchanged once travel has commenced.

2.12 Maps & Photographs: Maps are shown for general information and may not reflect actual routings, locations or services provided. Whilst photographs display places in geographic areas, they are not necessarily included in any tour. Photos reflecting hotel rooms may not be specific to the actual room occupied.

2.13 Invoice Errors or Omissions: We reserve the right to correct any errors in rates quoted or miscalculated for any service quoted in this website or via the Guest Contact Centre.

2.14 Carrier’s Liability: Advertised airlines will incur no responsibility or liability to any client aside from the liability that may be incurred as the carrier. Bookings with the carrier are also subject to the carrier’s terms and conditions as printed or referred to on their ticket and timetable regulations.

2.15 Price & Information Validity: Prices and information were correct at time of advertising on this website.

3. Bookings

3.1 Bookings must be accompanied with payment. Unless payment is made, we shall not consider that a booking has been made.

3.2 The person making a booking shall be deemed to have accepted these Terms & Conditions on behalf of all persons named in the booking.

3.3 If you create an itinerary on any of our Sites without making a booking, we reserve the right to delete all or any part or that itinerary from any of our databases.

3.4 A credit card transaction fee of 1.4% will be applied on the total cost of the booking.

3.5 Full payment must be made at the time of booking. Unless payment is received in full at the time of your booking, for all persons named in the booking, we shall not consider the booking to be firm or completed. (Full payment means payment of all costs and charges relating to the items in your itinerary, including (but not limited to) all fees, costs and other charges relating to matters referred to in clause 2 of these Terms & Conditions.)

3.6 Full documentation in respect of your booking will be emailed to you once your booking is confirmed and paid in full.

3.7 We reserve the right to correct, at any time, any errors in respect of any information appearing on the booking documentation. You warrant that you shall advise us of any errors contained in the booking information immediately it comes to your attention.

3.8 If you cancel or terminate your holiday, you will forfeit all monies paid.

3.9 No refund is available for cancellations after arrangements have been paid for. Please note that employees of any supplier are not authorised by Creative Holidays to make any undertakings to our clients in respect of refunds or other matters.

3.10 If you have a valid consumer claim or complaint pursuant to the consumer laws of the State of New South Wales, Australia, then you agree to first attempt to resolve your complaint or claim, as the case may be, by mediation with us. You do so by forwarding your complaint or claim, as the case may be, to us, together with any supporting documentation, within 30 days of the last activity on your itinerary, as described in the booking you made pursuant to the Site. 4. Your Warranties

4.1 You hereby warrant that prior to making any booking, you have familiarised yourself with any health or visa requirements that may be applicable in the areas that you intend visiting, or alternatively, you have familiarised yourself with all health, financial, religious, political and/or other requirements in respect of any of the arrangements described in your itinerary and required pursuant to your proposed booking.

4.2 You remain responsible for all entry, exit, health and other documents required by law, regulations, orders, demands or requirements of the countries visited or transited.

4.3 You shall carry a valid passport at all times.

4.4 Passport, visa and vaccination requirements are not our responsibility and we are not liable for any loss or expense due to your failure to comply with these requirements.

4.5 You accept that you may be travelling through areas of political or climatic instability, high altitude and remote areas without proper medical services. You accept all risks inherent thereto.

4.6 You shall be responsible for the costs associated with all matters, requirements and documents referred to in clause 4 herein.

5. Indemnity

You agree to indemnify us, our subsidiaries, our officers, our employees and our agents against all losses, costs, damages and claims in respect of any -

(a) Breach of these Terms & Conditions by you

(b) Act or omission by you or an officer, employee or agent of you or

(c) Claim, action, demand or proceeding by a third party against us, our subsidiaries, our officers, our employees or our agents, which claim action, demand or proceeding has been contributed or caused by you in any way, or by an officer, employee or agent of you, in any way.

6. Disclaimers & Limitation of Liability

6.1 We always do our best to ensure that your arrangements and itinerary items are satisfactory and delivered to the highest possible standard. We therefore accept responsibility for, but only to the extent of, any loss or damage sustained by you as a result of our negligence.

6.2 We shall not be liable in respect of any act, omission or default whether negligent or otherwise, of any service or product provider or any other person providing the services or products in connection with your itinerary/booking.

6.3 We do not accept any responsibility in contract or in tort for any injury, damage, loss, delay, additional expense or inconvenience caused directly or indirectly by any eve whatsoever which is beyond our control or which is not preventable by reasonable diligence on our part.
